Welcome to Sports Simple Stats. These Terms & Conditions (“Terms”) govern your use of our website, our Basketball Simple Stats, Lacrosse Simple Stats, and Soccer Simple Stats mobile applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.

1. ACCEPTANCE OF TERMS

By accessing or using the Platform, you agree to comply with and be bound by these Terms. We may provide additional terms for specific features, which become part of these Terms when you use those features.

2. ELIGIBILITY

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 and able to form a binding contract. If you use the Platform on behalf of a team, organization, or other entity, you represent that you have authority to bind it to these Terms. The Platform lets you record information about players who may be minors; you are responsible for having the authority and any consents necessary to do so.

3. CHANGES TO TERMS

We may modify, update, or replace these Terms at any time. We will post a notice of significant changes on the Platform and update the effective date. Your continued use after changes take effect constitutes acceptance of the revised Terms.

4. ACCOUNTS, SIGN IN WITH APPLE, AND ACCOUNT DELETION

You can use the app without an account. Some features (such as viewing your stats on other platforms and certain rewards features) require you to link an account using “Sign in with Apple.” You are responsible for maintaining the security of your device and Apple ID and for activity under your account.

You may unlink your Apple Account at any time from the app’s Account screen. Unlinking removes our server-side identity-mapping record and signs you out of our authentication service without affecting your stats.

You may permanently delete your account at any time from the app’s Account screen. Deleting your account revokes your Sign in with Apple token, deletes your authentication account and our identity-mapping record, deletes any Cloud Backup files we hold for you, and turns off Cloud Backup. Your stats remain on your device and in your own iCloud. Deletion is described further in our Privacy Policy.

5. YOUR DATA, ICLOUD, AND CLOUD BACKUP

The players, teams, games, and statistics you enter are stored on your device and in your own private iCloud account, which you control through your Apple ID. We do not control or guarantee Apple’s iCloud service or its availability.

Cloud Backup is an optional feature, off until you enable it, that uploads a copy of your data to our secure storage so our support team can help you recover it if it is lost. Backups are retained for approximately six months and then deleted automatically. Cloud Backup and any recovery assistance are provided on a best-effort basis; we do not guarantee that any data can be recovered, and you remain responsible for maintaining your own copies of important data. You may export your data at any time using the app’s export features.

6. PURCHASES, SUBSCRIPTIONS, AND CREDITS

The Platform offers paid features, subscriptions (such as Pro/Standard plans), and consumable in-app credits. Prices and features are shown in the app. Purchases are processed by Apple through the App Store and are subject to Apple’s terms; auto-renewing subscriptions renew until cancelled through your App Store account settings. In-app credits and rewards have no cash value, are not transferable except as expressly provided, and may expire or be adjusted as described in the app. Except as required by law or Apple’s policies, purchases are non-refundable; refund requests for App Store purchases are handled by Apple.

7. AFFILIATE, REFERRAL, AND SPONSORSHIP PROGRAMS

We operate affiliate/referral and sponsorship programs (see sportssimplestats.com/affiliate), administered in part through WinWinKit, with tiers that may pay based on downloads, conversions, and/or a percentage of revenue.

If you participate:
– You must provide accurate application and payout information and keep it current.
– You must promote the Platform lawfully and honestly, must not make false or misleading claims, must not use spam or deceptive practices, and must disclose your material connection to us (for example, that you earn commissions) where required by law (including FTC guidelines).
– Referral, conversion, and reward tracking is measured by us and WinWinKit; our records are the basis for attribution and payouts, and we may withhold or reverse payouts for fraud, abuse, chargebacks, or violations of these Terms.
– Sponsorships (advertising, fundraisers, professional development, charitable contributions, and community support) are granted at our discretion and may have their own written terms.
– We may change, suspend, or end the programs, tiers, or payout rates at any time. Participation does not create an employment, partnership, or agency relationship.

8. INTELLECTUAL PROPERTY

The Platform and its content, features, and functionality are owned by Sports Simple Stats and protected by intellectual-property laws. You may not copy, modify, distribute, create derivative works from, reverse engineer, or publicly display any part of the Platform without our prior written consent, except as permitted by law.

9. YOUR CONTENT

“Your Content” means the data and materials you enter or upload, including player and game information. As between you and us, you retain your rights in Your Content. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, back up, reproduce, and process Your Content solely to operate and provide the Platform to you (for example, to sync, back up, export, and display it), and to the extent needed to comply with law. This license ends when Your Content is deleted from our systems, except for copies retained as required by law or that persist temporarily in routine backups. You are responsible for Your Content and represent that you have the rights and consents necessary to provide it.

10. USER RESPONSIBILITIES

You agree not to:
– violate any applicable laws or regulations;
– infringe the rights of others, including privacy and IP rights;
– record or upload information about others without appropriate authority or consent;
– transmit viruses, malicious code, or harmful content;
– use the Platform for unauthorized or illegal purposes;
– attempt to gain unauthorized access to, disrupt, or interfere with the Platform, its security, or other users’ data.

11. THIRD-PARTY SERVICES

The Platform relies on third-party services, including Apple (iCloud/CloudKit, Sign in with Apple, the App Store), Google Firebase, Google AdMob, and WinWinKit. Your use of those services may be subject to their terms and policies. We are not responsible for third-party services and do not guarantee their availability.

12. DISCLAIMER OF WARRANTIES

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that data (including backups) will always be available or recoverable.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Sports Simple Stats and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Platform. To the maximum extent permitted by law, our total liability for any claim relating to the Platform will not exceed the greater of the amount you paid us in the twelve months before the. claim or USD $50.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Sports Simple Stats and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Platform, Your Content, or your violation of these Terms or applicable law.

15. TERMINATION

We may suspend or terminate your access to the Platform at our discretion, without prior notice, for any reason, including violation of these Terms. You may stop using the Platform at any time and may delete your account as described in Section 4. Sections that by their nature should survive termination will survive.
